TERMS OF SERVICE (UQ SHOP)

These Terms of Service (“Terms”) apply to your use of the UQ Shop website (“Site”) and any purchases made through it. By accessing the Site or placing an order, you agree to these Terms, as well as our Privacy Policy and Refunds & Returns Policy (together, the “Policies”).

If you do not agree, do not use the Site.

1. About UQ Shop

The Site is operated by UQ Sport (referred to as “UQ Shop”, “we”, “us”, “our” in these Terms).

2. Eligibility and acceptable use

You must be able to enter into a legally binding contract to place an order.

You must not use the Site:

  • for any unlawful purpose
  • to interfere with the Site’s operation or security
  • to introduce malicious code (viruses, malware, etc.)
  • to scrape, crawl, or collect data from the Site without our permission
  • to infringe intellectual property or privacy rights

We may suspend or restrict access to the Site if we reasonably believe these Terms have been breached.

3. Products, pricing and availability

We aim to display products, descriptions and pricing accurately. However:

  • product images are for illustrative purposes and colours may vary by device
  • prices and availability may change without notice
  • some items may have purchase limits per customer/order, especially during promotions or high-demand periods

If a product becomes unavailable after you place an order, we will contact you and offer a refund or an alternative where appropriate.

4. Orders and payment

When you place an order, you are making an offer to purchase. We may accept or decline an order (including where we suspect fraud, unauthorised activity, pricing errors, or stock issues).

Payments: Payment is taken at checkout. If your payment is declined, reversed, or later flagged as unauthorised, we may cancel the order and refund or recover funds where applicable.
Pricing errors: If an item is advertised at an incorrect price due to an error, we may cancel the order and refund you, or contact you to confirm whether you wish to proceed at the correct price.

We may need to cancel or adjust an order if:

  • there is a pricing or product description error
  • payment is not authorised or is reversed
  • the order is flagged for suspected fraud
  • stock is unavailable

If we cancel an order after payment is taken, we will refund you to the original payment method.

Payments are processed via third-party payment providers. We do not store full payment card details.

5. Delivery

Delivery timeframes are estimates only and may be affected by factors outside our control (e.g., carrier delays, weather, peak periods). Risk in goods generally passes to you on delivery.

 as soon as possible and include your order number and supporting details (including photos where relevant).

6. Returns and refunds

Returns, exchanges and refunds are handled in accordance with our Refunds & Returns Policy and the Australian Consumer Law. For full details, refer to the Refunds & Returns Policy.

7. Promotions and gift cards

From time to time, we may run promotions with specific terms (e.g., start/end dates, exclusions, limits). Promotional terms apply in addition to these Terms.

Gift cards/vouchers (if offered) are subject to any terms provided at the time of purchase and may be excluded from returns except where required by law.

8. User content and feedback

If you submit reviews, feedback, ideas, images, or other content (“User Content”), you confirm that:

  • you have the right to submit it, and it does not infringe third-party rights
  • it is not unlawful, misleading, offensive, or defamatory

We may moderate or remove User Content at our discretion.

9. Intellectual property

All content on the Site (including text, images, logos, product names, and design elements) is owned by or licensed to us and is protected by intellectual property laws. You may not use, reproduce, or distribute Site content without our prior written permission, except as permitted by law.

10. Privacy

Personal information is handled in accordance with our Privacy Policy.

11. Disclaimers

To the maximum extent permitted by law:

  • the Site is provided on an “as is” and “as available” basis
  • we do not guarantee uninterrupted or error-free access to the Site

Nothing in these Terms excludes any consumer guarantees or rights you have under the Australian Consumer Law that cannot be excluded.

12. Limitation of liability

To the maximum extent permitted by law, and subject to non-excludable rights under the Australian Consumer Law, we are not liable for indirect or consequential loss, including loss of profit, revenue, data, or business interruption arising out of your use of the Site or purchase of products.

Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.

14. Changes to these Terms

We may update these Terms from time to time by posting the updated version on the Site. Changes take effect from the date posted. Your continued use of the Site after changes are posted means you accept the updated Terms.
